STEP 1: Finding a House

STEP 2: Survey the property

Before you set up a company you have to conduct a land/property survey to get an overview of the current status of the property, things that need to be done (like electricity, water, aso.) and get a proper picture of the properties boundaries.

STEP 3: Setting up Your Thai Company

Once you have decided which house you are going to purchase, always consult a lawyer before signing any documents. Foreigners may not own a house in their name – however their Thai registered company may own the house. There are different forms of business entities in Thailand. The most commonly used is a Thai Limited Company. There are certain business registration criteria for the limited company.

STEP 4: Buying the House

Once you registered your Thai Limited Company you (or your property lawyer) should do a title search and check the contracts before signing. Common problems are the type of land deed the house or villa stands on, previous owners and construction on the site.

Leasehold Agreements: Foreigners can obtain full interest on a lease in Thailand throughout the specified lease term by signing leasehold agreements. In this form you don’t need to set up a Thai company. You have full rights over the leasing agreement, can sell it or sub rent it. The maximum duration of such an agreement is 30 years.
